The court always has a residual discretion to allow someone to present someone else if, in special circumstances, it is appropriate to do so. I will make it clear that in this case the court is quite satisfied that it would not be right allow Mr Landau to use the power of attorney to appear on behalf of his daughter. The court has also had an opportunity of looking at the decision of Knox J in this matter and on the material contained in the papers. The court takes the view that the decision of the learned judge was perfectly appropriate and the right decision, so there is nothing in Mr Landau's application to this court in any event. However, we also take into account that Mr Landau has said that his daughter is applying for legal aid. We will reserve to the daughter the ability to make an application on her own behalf through lawyers. Nothing we have said today is intended to prevent her doing that if it is appropriate to do so.
