02/21/201247 ORDER: The Court hereby decides four preliminary issues: First, the Court finds that the turnover application was properly brought as a motion rather than a special proceeding. Second, the proceedings need not be stayed in light of an action filed by the children of the judgment debtors currently pending in the Middle District of Florida. The Millard Foundation intervened in this case and objects to the Court's exercise of personal jurisdiction over it. Third, the Court finds that since the Commonwealth has made a threshold showing that the judgment debtor has an interest in the Merrill Lynch account, the relevant question is whether the Court has in personam personal jurisdiction over the garnishee Merrill Lynch rather than over the Millard Foundation.
